Any advice would be appreciated on this, I tried to take a picture of the sea using a slow shutter Speed to give a blurred effect to the water but my pics were all over exposed, I tried to use a smaller aperture and reduced the ISO to 100 but I was unable to take a picture. Camera: Canon 40D lense was just the Kit Lense 17-85. Do I need to use an ND filter?

Try capturing right after the sun disappears in the horizon. And try using ND filter when the sun is high above the horizon.I've tried overexposing my photos at first when the sun was still setting, but after it was gone I captured it again and finally got the desired blur effect same aperture setting and exposure time... I used ISO 100 film.Hope this works with your Canon 40D.

30 minutes before sunrise is the best time to do this, and also the amount of wave motion is going to affect your shots. A slow, rolling wave will give you better results than a plunging breaker. The period of the waves will also affect the shot. When I get home, I will give more specifics.
